As the owner of several discussion lists, I thought I would share some
findings regarding "List Liability". I am not a lawyer, but I've read a
few
articles and attended a panel discussion on the subject.
It is being found, through several different court cases in the United
States, that the owners of moderated discussion lists ARE LIABLE for
remarks
made on their lists. The rulings made by the courts outline the
following:
because the postings are moderated by the owner, or an agent of the
owner,
the owner of the list is SOMEWHAT responsible. I believe that the level
of
responsibility is being decided by the level of moderation imposed by
the
list owner.
These rules are changing very quickly, as the courts in the United
States
decide legal cases involving new technology. As the rulings go down in
the
books, all other cases look back to the previous rulings for guidance.
I do believe SIPA and all other owners of moderated discussion list are
liable. The extent of that liability is still unclear.
